Reimagining the U.S. Constitution

Idiot-proofing Democracy is a rewrite of the United States Constitution to address many omissions and flawed assumptions.
Critical assumptions about fundamental human rights, legal principles, and the role of the country in the world need to be stated explicitly to prevent corruption by antidemocratic forces.
It is time to push for unapologetic support for human rights and a democratic government that tolerates capitalism but moderates unabashed greed.

The biggest feature is the addition of Fitness for Duty Assessments to verify that high level government employees are physically and mentally adequate for the job, know what their job is, and are not easily bribed through financial conflicts of interest. The Executive and Legislative Branch employees also must qualify for national security clearances on their own merits, not be given them automatically.

Another major change is to redefine how Electoral Districts are formed. The current laws allow truly bonkers shapes crafted to eliminate political power from anyone who is not the majority party. I propose a simple six-boundary rule to allow some selection of larger regions, without becoming gerrymandering.

Other features include:

  • No Electoral College. Elect President & VP by simple majority vote.

  • No corporate personhood (Citizen’s United).

  • Explicit definition of separation of church and state, presumption of innocence, rule of law. Equal protection and equal rights under the law.

  • No official language. Dual citizenship permitted.

  • No incarceration for no cash bail when accused of non-violent crimes. Voting rights restored after incarceration. No death penalty or torture.

  • Right to food, water, shelter for all.

  • Healthcare – bodily autonomy defined. Universal healthcare.

  • Equal Rights – no discrimination based on marriage, race, ethnicity, sexual preference, disability, gender identity, or gender presentation.

  • Worker’s rights defined for equal pay, right to unionize, and adequate rest.

  • Education – Universal public K-12 education with free meals during school hours. Free public college or trade schools for two years. No public funding for private or religious education.
